What the Cloud Act and the Schrems II judgment mean

Cloud Act

The Cloud Act (2018) gives US authorities the right to request data from US cloud service providers – regardless of the country where the data is stored. As long as a US company owns the service and servers, it doesn't matter that customers and their data are located in Sweden, for example. For them, the Cloud Act takes precedence over both our national and European legislation.

The Schrems II judgment

In 2020, the Court of Justice of the European Union ruled on the Schrems II case. The main issue was whether Facebook Ireland was allowed to transfer personal data of European citizens to Facebook USA. Previously, EU operators have been able to transfer personal data to the US if the US company was a member of the Privacy Shield. However, the ruling means that the Privacy Shield framework is declared invalid because it violates, among other things, the GDPR.
